Overview: This bill prohibits employers from discriminating against employees or job applicants based on their family caregiving responsibilities.  

Prohibited Actions

The bill also prohibits employers from taking adverse action against employees due to family caregiver responsibilities.  Adverse actions include: harassment relating to compensation; advancement; terms; conditions; or scheduling or work hours. This bill prohibits employers from retaliating against employees who exercise their rights under this proposed legislation.  

The Equal Employment Opportunity Commission will enforce violations of this bill. This may include a penalty of up to $10,000 for each act of discrimination and $5,000 for each act of retaliation. Penalties collected by the Commission will be transferred to the Family Caregiver Anti-discrimination Fund to be used for a grant program.

This bill establishes a grant program to enable nonprofit organizations, institutions of higher education, or research centers to assist in preventing and combatting discrimination against applicants and employees with family caregiver responsibilities. Grant recipients can use the funds to educate employees about the prohibited actions and caregiver rights, conduct educational training for employees, provide support to applicants and employees facing caregiver discrimination, and recruit and hire staff and volunteers to carry out these activities.

Within one year, the Equal Employment Opportunity Commission will submit an evaluation report to Congress.
